Terms and Conditions for Energy Performance Certificates, Display Energy Certificates, Air Conditioning Inspection Reports and Floor Plans.
- Introduction
These terms and conditions (“Terms”) govern the provision of Energy Performance Certificates (EPC), Display Energy Certificates (DEC), Air Conditioning Inspection Reports (ACIR) and Floor Plans (collectively referred to as “EPC Services”) by Beach Energy Limited, a company registered in the United Kingdom, to its clients (“Client” or “You”). By engaging our Services, you agree to abide by these Terms.
2. Definitions
- “EPC” refers to the Energy Performance Certificate, a document issued in accordance with UK regulations that assesses the energy efficiency of a property.
- “Floor Plans” refers to the graphical representation of the layout and dimensions of a property.
- “DEC” refers to Display Energy Certificates
- “ACIR” refers to Air Conditioning Inspection Reports
- “Client” refers to the individual or entity that requests and pays for the Services.
- “Company” refers to Beach Energy Limited, a registered company in the UK.
- “Party” refers to either the Client or the Company, and “Parties” refers to both collectively.
- “Commencement Date” refers to the date on which the Client’s order for Services is accepted by the Company.
3. Services
3.1 Scope: The Company agrees to provide EPC, Floor Plans and other services to the Client in accordance with the Client’s order.
3.2 Accuracy: The Company will make reasonable efforts to ensure the accuracy of the EPC and Floor Plans. However, the Client acknowledges that variations may occur due to property conditions or unforeseen circumstances. Please note that Floor Plan measurements are for guidance only.
3.3 Regulatory Compliance: The Company shall comply with all relevant UK laws and regulations governing the provision of EPC Services.
3.4 Subcontractors: The Company may use fully qualified subcontractors to provide ‘EPC Services’.
3.5 Accreditation body: Elmhurst Energy www.elmhurstenergy.co.uk.
3.6 Floor plans: software provided by PlanUp www.planup.co.uk
4. Ordering and Payment
4.1 Ordering: Orders for Services can be placed via our website or by contacting our customer support.
4.2 Payment: The Client shall pay the Company the agreed-upon fees for the Services. Payment details and terms will be provided in the Company’s invoice.
5. Delivery
5.1 Delivery Time: The Company will make reasonable efforts to complete the EPC Services within the agreed-upon time frame. However, the Company does not guarantee specific delivery dates and we cannot be held responsible for delays outside our control.
6. Client Obligations
6.1 Access: The Client shall provide the Company with access to the property at the scheduled time for inspection, as necessary for the provision of the Services.
6.2 Cooperation: The Client agrees to cooperate with the Company during the provision of Services and provide any necessary information requested.
7. Intellectual Property
7.1 Ownership: All intellectual property rights in the EPC Services produced by the Company shall remain the property of the Company.
8. Limitation of Liability
8.1 Exclusions: The Company shall not be liable for any loss or damage arising from the use or reliance on the EPC Services, except to the extent caused by the Company’s negligence.
9. Confidentiality
9.1 Confidentiality: Both Parties agree to treat all information exchanged during the provision of Services as confidential.
10. Termination
10.1 Termination: Either Party may terminate this agreement with written notice if the other Party breaches these Terms and fails to remedy the breach within 30 days.
11. Governing Law
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
12. Amendments
12.1 Amendments: These Terms may be amended by the Company from time to time, and the updated Terms will be posted on the Company’s website.
